Proofs and Prototypes for Sale: The Licensing of University Inventions
نویسندگان
چکیده
Proponents of the Bayh-Dole Act argue that industrial use of federally-funded research would be reduced without university patent licensing. Our survey of U.S. universities supports this view, emphasizing the embryonic state of most technologies licensed and the need for inventor cooperation in commercialization. Thus, for most university inventions, there is a moral hazard problem with inventor e¤ort. For such inventions, development does not occur unless the inventor’s income is tied to the licensee’s output by payments such as royalties or equity. Sponsored research from the licensee cannot by itself solve this problem.(JEL O31, O34, O38) ¤Forthcoming in the American Economic Review. We gratefully acknowledge support from the Sloan Foundation and the National Bureau of Economic Research under the NBER Project on Industrial Technology and Productivity. Thursby thanks the Purdue Technology Transfer Initiative for support. Inventor Moral Hazard in University Licensing: The Role of Contracts
We examine commonly observed forms of payment, such as milestones, royalties, or consulting contracts as ways of engaging inventors in the development of licensed inventions. We show that when milestones are feasible, royalties are not optimal unless the licensing firm is risk averse. The model also predicts the use of consulting contracts which improve the firm’s ability to monitor inventor ef...
متن کاملA pilot survey on the licensing of DNA inventions.
Despite ethical concerns about gene patents, virtually no empirical evidence exists to support claims about either positive or negative effects, and extremely little is known about the intellectual property protection strategies of firms and universities. This article discusses the results of a pilot study to examine patenting and licensing philosophies, policies, and practices of different typ...
متن کاملThe Halo Effect and Technology Licensing: The Influence of Institutional Prestige on the Licensing of University Inventions
Sociologists and organizational theorists have long claimed that the processes of knowledge creation and distribution are fundamentally social. Following in this tradition, we explore the effect of institutional prestige on university technology licensing. Empirically, we examine the influence of university prestige on the annual rate of technology licensing by 102 universities from 1991 to 199...
متن کاملAppropriability and the timing of innovation: Evidence from MIT inventions
At least since Arrow (1962), economists have believed that strong property rights are necessary for firms to invest in innovation. This belief was a key principle underlying the Bayh-Dole Act, which gave universities the right to own and license federally funded inventions, because the commercialization of university inventions requires private firm investment in development, given the early st...
متن کاملThe International Landscape of Medical Licensing Examinations: A Typology Derived From a Systematic Review
Background National licensing examinations (NLEs) are large-scale examinations usually taken by medical doctors close to the point of graduation from medical school. Where NLEs are used, success is usually required to obtain a license for full practice. Approaches to national licensing, and the evidence that supports their use, varies significantly across the globe. This paper aims to develop a...
